Access to and use of the website available at https://www.lapochette.ch (hereinafter the “Site”) implies the User’s tacit and unconditional acceptance of these terms and conditions, as set forth in their most recent version available online.
For the purposes of this Agreement, “User(s)” refers to any person who logs in to and browses the Site.
SITE DESCRIPTION
The Publisher offers for sale on the Website pouches, placemats, and personalized items (hereinafter the “Products”).
For any questions regarding the Products and their use, the User is encouraged to contact Lapochette using the contact information provided in the “Customer Service” section of these Terms.
ACCESS AND AVAILABILITY
Access to the Site is free and provided continuously and permanently, except in cases of force majeure or events beyond the Publisher’s control, and subject to any outages and technical interventions, maintenance, and updates necessary for the proper functioning of the Site.
Furthermore, due to the very nature of the Internet, the Publisher cannot guarantee that the Site will be operational 24 hours a day, 7 days a week.
LIABILITY
The Publisher is also faced with the technical impossibility of displaying the colors of the Products in a manner that strictly matches reality, given the wide variety of devices used to view the Site (computer screens, television screens, tablets, cell phones…), all of which have widely varying limitations, resolutions, settings, and display qualities.
The Publisher shall therefore not be held liable for any direct or indirect damages incurred by Users or third parties that may arise from the information published on the Site or, more generally, from accessing and using the Site.
INTELLECTUAL PROPERTY
All images and photographs displayed on the Site, particularly those depicting and illustrating the Products, are protected by copyright and all other intellectual property rights and belong to the Publisher or to third parties who have authorized the Publisher to use them.
Any unauthorized reproduction and/or display of any kind of an image or photograph featured on the Site constitutes infringement and will be subject to legal action.
Similarly, all other data of any kind, including but not limited to text, graphics, logos, icons, images, photographs, audio or video clips, trademarks, software, and website features appearing on the Site are necessarily protected by copyright, trademark law, and all other intellectual property rights, and belong to the Publisher or to third parties who have authorized the Publisher to use them.
Under these terms, the User agrees not to reproduce, summarize, modify, alter, or redistribute, without the Publisher’s express prior authorization, any text, title, application, software, logo, image, graphic design, trademark, information, or illustration for any use other than strictly personal use, which excludes any reproduction for commercial purposes or mass redistribution.

PRIVACY AND PERSONAL INFORMATION
Users have the right to access their personal data, as well as the right to modify, correct, and delete it.
To exercise this right, they need only send a letter or email to the address listed under “Customer Service” in these Terms and Conditions.
Personal data relating to Users—collected directly through forms and indirectly while they browse to and on the Site—as well as any future information, is intended solely for the Publisher’s exclusive use, in connection with the provision of services offered to Users on the Site, as well as for the compilation of statistics for internal use, and shall not be disclosed or transferred to any third parties, other than the technical service providers responsible for managing the Site, who are required to respect the confidentiality of the information and to use it only for the specific purpose for which they are engaged.
The User is informed and has given consent to the fact that the operation of the Site necessarily requires the Publisher to place a “cookie” on the User’s computer while the User is browsing the Site, namely a file stored on the User’s computer’s hard drive that automatically identifies the User during subsequent visits to the Site and facilitates the User’s navigation of the Site, as well as the use of the services offered there.
MISCELLANEOUS
The Publisher reserves the right to unilaterally modify the terms of these conditions.
The new provisions will govern all future relations between the parties, and only the new version will be binding on them.
